The Supreme Den Haag jurisdiction in an appeal case against a local politician Amsterdam in March 2013 was cleared by the Court in Amsterdam. In the election campaign 2010 The man had made discriminatory statements about homosexuals, but the Court found in 2013 he had to have that freedom. The Supreme Court does not agree with it today and it refers the case back to Amsterdam for reassessment. The judges argue that a politician has a responsibility to prevent it spreading statements that conflict with the law and with the principles of constitutional democracy. This not only involves statements that incite hatred, violence or discrimination, but also statements that incite intolerance.
