The Netherlands Institute for Human Rights rules in a case of a gay man against a national blood donation foundation from Amsterdam. The man feels discriminated against for being in 2016 is not allowed to donate blood because he has had sexual contact with another man in the previous 12 months. The Institute states that there is indeed direct discrimination, but that this is permissible in this case because of the importance of public health. The foundation wants to prevent contamination through blood donation and has insufficient options for this through testing. Because the man belongs to a risk group, he may be excluded.
