The Human Rights Institute examines the complaint of a man of Afghan nationality living in Great Britain. He was born in early February 2016 Refused on a flight from Schiphol to Great Britain because he did not want to show his visa and residence permit. He felt that he was the only one being checked and experienced the treatment as humiliating. At the time, the staff also did not answer questions about why the check happened. The College states that he was treated differently from EU nationals because of his nationality. This is an indirect distinction based on nationality. However, this is justified in this case from the laws of Great Britain and the Netherlands. According to the College, the refusal was therefore not discriminatory, even though this feeling has arisen in the man.
